These Terms & Conditions ("Terms") govern your use of the website and services offered by Bark Media Private Ltd. ("Bark", "we", "us"). By accessing or using our services, you agree to these Terms. If you do not agree, please do not use our website or services.

1. Agreement to Terms

These Terms govern your use of the website and services offered by Bark Media Private Ltd. By accessing our services, you consent to these conditions. If you do not accept them, you should not use the platform.

2. Services Provided

Bark offers marketing services that may include:

• Digital advertising campaign management
• Media buying
• Strategy consulting
• Retargeting and audience segmentation
• Landing page or funnel development

Service scope may vary based on the plan or proposal you agree to.

3. Account Registration

To request services, you may need to provide information such as your name, business details, and email address. You are responsible for all use of your account and for maintaining the confidentiality of your access credentials.

4. Package Purchase & Payment Structure

a. Setup Fee (Initial Payment)

Your first payment is a one-time setup fee. Successful payment triggers a receipt and a confirmation email detailing your package selection and subscription charges.

b. Subscription Billing

Nine calendar days after the initial setup fee, your monthly subscription (management fee) is automatically charged. Recurring charges occur every 30 days, with invoices provided.

c. Automatic Renewal

Subscription billing continues automatically each month until cancelled in line with the cancellation policy below.

5. Cancellation Policy

• Written notification is required at admin@barkmedia.io.
• Cancellations must be submitted at least 5 calendar days before the next scheduled payment.
• Requests submitted after this window may incur one final charge.

6. Money-Back Guarantee

a. 60-Day Guarantee

We offer a 60-day money-back guarantee from the date of your initial setup payment. Refunds cover up to two months of monthly management fees only. The initial setup fee is non-refundable.

b. Refund Conditions

• Formal requests must reach admin@barkmedia.io within 50 days of the setup payment.
• Only the first two billing cycles' management fees qualify.
• Refunds do not apply to any ad spend paid directly to third-party platforms.
• No refunds are accepted after 60 days.

7. Client Responsibilities

You agree to:

• Provide timely access to your advertising platforms (for example, Google Ads, Facebook).
• Ensure all materials you provide are accurate, lawful, and compliant.
• Cooperate in good faith and respond to communication within reasonable timeframes.

Non-compliance may impact performance or delay delivery.

8. Onboarding Process

• Setup fee payment is made.
• An email is sent with confirmation, an onboarding questionnaire, and a subscription billing reminder.
• You submit the onboarding questionnaire.
• Bark requests access to your ad account.
• Your campaign is built.
• The campaign is prepared for launch.
• Consultation-first clients receive package options before proceeding with payment and onboarding.

9. Third-Party Services

Payments are securely processed via Stripe. We do not have access to your full card details, and Stripe's terms apply to those payments. We may also use third-party tools for analytics, communication, or tracking.

10. Acceptable Use

You may not:

• Use our services for unlawful purposes.
• Transmit viruses or malware.
• Violate the intellectual property rights of others.
• Interfere with our systems.

We reserve the right to suspend or terminate services if these Terms are violated.

11. Intellectual Property

• You retain ownership of your Google Ads account and all ad assets created during our engagement.
• All scripts, automation, AI systems, and proprietary optimisation tools developed by Bark remain our intellectual property and may not be reused or transferred without written permission.
• Your original assets (logos, brand materials, past campaigns) remain owned by you.

12. Disclaimers & Limitation of Liability

• We make no guarantees of specific results or return on investment.
• Services are provided "as is", without warranties of any kind.
• Bark is not liable for indirect or consequential damages, including loss of business, data, or revenue.

13. Termination

Either party may terminate with written notice. Subscribers must cancel at least 5 business days before the next cycle to prevent renewal. Bark reserves the right to terminate service at any time for breach of these Terms or misuse.

14. Governing Law

These Terms are governed by the laws of Singapore. As we serve clients in the United States, local consumer protection laws may also apply.

15. Changes to Terms

We may update these Terms periodically. Changes become effective once posted on this page. Continued use of our services signals your acceptance of any revisions.
